(NOTE: From the Birmingham News, January 30, 1966: Mr. Johnson, at the time
of his death was Alabama's oldest tax collector. He had been appointed to this
position by Governor Bibb Graves, and served in the position for 38 years.
He was the son of Dr. Gaius R. & Mallie Lee Johnson, and was a member of the pioneer Perry County family which came to Marion from Virginia in 1816.
He was a lifetime member of St. Wilfrid's, where he served for many years as vestryman and treasurer. He was survived by his wife, Mrs. Margaret Lockhart Johnson, and a daughter, Mrs. Robert W. Johnson, of Alexandria, Virginia.)

(NOTE: He was born in Hale County, son of Warren Dubose & Hannah Holliday
(Rodgers) Stewart, the former a South Carolinian who came to Alabama when we
was about seven years old, was a planter who resided in Hale County until 1848
when he moved to Kemper County, Miss., where he died.
James Harvey Stewart's grandfather was Allen Stewart, a native of Scotland, who came to the U.S. in 1799, settled near Camden, S.C., later moved to Tuscaloosa County, A.L.
James Harvey received his education in Prof. Henry Tutwiler's Greene Springs Academy. He attended the University of Virginia in 1860-1861, and withdrew to serve as a private in Co.D., 11th A.L. Inf., C.S.A. He fought at Seven Pines, Gaines' Mill, Gettysburg, and was present at the surrender at Appomattox. He was wounded at Gaines' Mill and at Gettysburg.
After the war he studied law in Marengo County and was admitted to the bar in 1866, and removed to Uniontown where he practiced with J.B. Christian. In 1880 he was elected Probate Judge of Perry County. In 1886 he removed to Marion where he practiced law. In 1901 he was a member of the constitutional convention.
In November, 1988, he married Virginia, daughter of Thomas Madison & Elizabeth

(NOTE: He was born in Sumter District, SC; son of William Middleton & Elizabeth
Wiche (Watson) Brooks, natives of VA who emigrated to SC, then to Marengo Co.
AL in 1833.
Judge Brooks attended SC College until the death of his father. He then took charge of his father's estate and in 1838 was licensed to practice law. He practiced in Linden and was associated with William Robinson and William M. Boyd.
In 1840, he was elected to solicitor of his district, and re-elected in 1844. He later practiced law in Mobile, and moved to Marion in 1853. Soon after arriving in Marion he was appointed to the circuit bench of Governor John A. Winston. In July, 1856, he resigned from the bench and formed a law partnership with Col. Warren Garrett, which became one of the best firms in Alabama.
In January, 1860, he was a delegate to the Democratic Convention in Charleston. He spoke for Breckenridge and Lane. When the Alabama convention met to formally secede from the Union, he was elected president of that body.
In 1866 he located in Selma and practiced with John Haraison until 1886, when
he moved to Birmingham and became a partner in the firm of Brooks, Bush &
Vary.
His first wife was Ann Eliza Terrell of Dayton, AL. Later he married Annie E.
Thomas of VA. ISSUED:

enlisted in C.S.A. army at age 17, and served as Sgt-Major in the 25th AL and
was promoted to 1st Lt.; later secretary of the Union Iron Works Company of

My husband. (NOTE: Joseph James Seawell, son of Leonard Henderson and Mary (Perry)
Seawell, was born in Nov. 1831 at Raleigh, NC. He was educated at the University
of NC., and later removed to Alabama with his parents where he engaged in planting
at Marion.
In the Civil War, he served as a member of Co. I., 51st Alabama Cavalry, C.S.A. He lost a leg at the battle of Farmington, TN.
In 1866 he served as a representative from Perry County, and was a Democrat. He married his cousin, Ann Elisa, daughter of William & Eliza (Keenon) Seawell. They had two children.)

(NOTE: She was the daughter of Joshua and Mary (Boddie) Perry. She married Leonard
Henderson Seawell in Louisburg, NC on September 4, 1827. She died March 12,
1896 in her old colonial home just outside of Marion.
Leonard H. SEAWELL Nov. 30, 1805 - Nov. 22, 1858
Born in Raleigh, NC; died in Marion, AL. (NOTE: Leonard Henderson Seawell was
the son of Henry & Leonard Grizelle (Hinton) Seawell, the former was born
in Raleigh in 1772 and often represented his county in the NC legislature, became
judge in 1810 and served until his death on Oct. 6, 1835.
Leonard Seawell was educated at the Bingham School near Asheville, NC; and later graduated from the University of NC in 1825. In 1826 he completed the medical course at the Jefferson Medical College of Medicine in Philadelphia.
He brought his family to Alabama in 1833 and acquired a large tract of land where he turned his attention to cotton planting and stock raising on a large scale.
St. Wilfrid's Church was built largely through his donations. Issue:
1. Mary Indiana Seawell married Robert T. Jones, who was killed in the battle
of Seven Pines on May 30, 1862.

John Foster Vary was born July 18, 1811 in Oneida Co. NY and died September
8, 1899 in Marion. He set out for Cincinnati to find a job and there heard and
accepted a teaching position in Columbus, Miss. He later moved to Demopolis
where he taught and studied law. He first practiced in Linden and then in Marion.

(To reach this cemetery one must travel from Marion toward Greensboro on Highway # 14 to Webb's Store. Across the highway from the store some 300+ yards we find the old Scott Home (one time a two story log cabin, now a large frame home), take the next dirt road on the right and travel for about a mile to a negro baseball diamond. Three graves are located by the ball diamond. Mr. J. C. Webb said the cemetery is called the Flynn Cemetery, however only Abbotts have markers there; he also said that he remembers the old Flynn Home which stood on the other side of the dirt road some 300 yards away. The home was a two-story log house, but has been destroyed.)

collegiate course in July, 1847. Prosecuting his studies with ceaseless energy,
in March 1850, he received the / degree of M.D., from the Jefferson Medical
College at Philadelphia. / Returning home the second degree was conferred upon
him by the / University at which he graduated, after which he located in Carroll
Co. Miss. And commenced the practice of medicine. His profound professional
knowledge and high sense of honor elicited the admiration of all who knew him
and augured a future career as bright as useful. But a year had elapsed we were
called to morn his untimely end. / Being an exemplary member of the M.E. Church,
an obedient son and affectionate brother, he was peculiarly endeared to his
relations, who looked upon him with feeling of pride.

Army as a Sgt. in Co. H, 8th Ala. Cav. After the war he was a planter, also

The church was located in the vicinity of Scott's Station. I am informed that
the building was removed many years ago and rebuilt elsewhere. The monuments
are in fairly good condition, and a nice wire fence keeps animals off of the
grounds, therefore only a few stones are broken. Only one family plot is enclosed
within its own fence.

to the bar in 1833; for 8 years justice of the peace. Entered Ala. Leg. in 1839;
elected Speaker of House in 1843-1845; presidental elector in 1846; appt. to
Circuit Court in 1851-57. Elected as 16th governor of Ala.; withdrew his state
from the Union; ordered the seizing of forts & arsenals in Ala. In 1865
was seized and placed in Ft. Pulaski; released in Aug. because of failing health.
Practiced law in Marion until his death.)

In 1818 he removed to Jones Valley, in Jefferson County, Ala.; and in 1820 settled
in Perry Co., 8 miles west of Marion. He was a Whig and served in the Ala. Legislature

This interesting old cemetery is located in a wooded area near the farm of
Jimmie D. Woodfin, near the Hamburg Road. The cemetery is surrounded by what
was once a very fine wrought-iron fence, which was made in Philadelphia. At
one time a road ran to the side of the ancient burial ground, but now has become
a part of the forest. Huge trees have uprooted the fence in places and pushed
over stones. Nearly all of the stones are broken, and I am sure that some of
them are buried in the leaves and were not copied.
J. K. C. & ridley )Ransom) Poole were originally from Johnson County, North
Carolina. On February 4, 1822, he was one of seven commissioners appointed to
select a site for the county seat of Perry county. His will can be found in
the Probate Office of Perry County (see Perry County Wills). Next to his grave-stone
there is another grave with an identical stone. I feel that this is the grave
of Ridley Poole, but the stone has fallen, inscription down and I was unable
to turn it.
A son not buried in this cemetery was Ransom R. Poole, who married Susan Ivey.
This couple had a son, Robert Ransom Poole, who was born near Uniontown on Feb.
9, 1853; later attended Greene Springs Academy and Howard College; and who was
a planter at Faunsdale, Marengo County.
